Retransmission consent refers to a provision of the 1992 Cable Act that requires cable operators and other multichannel video programming distributors to obtain the consent of broadcasters before carrying their over-the-air programming. In exchange for carriage rights, the broadcaster typically requires that the operator pay a per-subscriber cash fee (and/or other compensation) for the right to carry the station. Retransmission consent fees are increasing every year and today account for a major portion of broadcasters’ revenue. The fees are passed along to subscribers in the form of increased cable television rates. Carriage negotiations between broadcasters and cable operators are often contentious and the breakdown in retransmission consent negotiations sometimes results in high-profile channel blackouts.

A bulk service agreement differs from a non-bulk or “retail” agreement (also known as an “access agreement” or a “right of entry agreement”) in that under the former it is the property owner (or, in the case of a condominium or other common interest development, the homeowners’ association (“HOA”)) – and not the individual subscribing resident – that receives and pays the monthly invoice from the service provider.
